Subject: Proposal for a Council Decision concerning the placing on the market, in accordance with Directive of the European Parliament and of the Council, of an oiled rape product (Brassica napus L., GT73 line) genetically modified for tolerance to the herbicide glyphosate
1. On 11 February 2004, the European Food Safety Authority (EFSA) delivered its opinion that genetically modified oilseed rape product (Brassica napus L., GT73 line) is as safe as its conventional counterparts for humans and animals, and in the context of the proposed uses, for the environment. The EFSA also found that the monitoring plan provided by the consent holder was appropriate for the intended uses of the GT73 oilseed rape.
2. In June 2004, the Commission submitted to the Committee established under Article 30 of Directive , a draft decision authorising the placing on the Community market of this product for a duration of 10 years.

However, the Committee was unable to give an opinion.
3. Therefore on 9 September 2004, in accordance with the Comitology Procedure, the Commission decided to submit a proposal for a Council Decision.

As from 26 October 2004, the date on which all linguistic versions were available, the Council may act by qualified majority within a period set at three months in accordance with Article 30(2) of Directive .
